OnlineGroups.net Terms of Service

  1. This document outlines the terms that the OnlineGroups.net service is provided under. It is an agreement between the operators of OnlineGroups.net site and its users.
  2. You should read this document carefully. By using our service, you are agreeing to what it contains.
  3. In this document, "we", "us", "the service" and related terms refer to Fiorenza Limited, the operator of OnlineGroups.net. "You", "your", "user", "subscriber" and related terms refer to you or the legal entity you represent as the subscriber of the service.
  4. This document should be read together with the Privacy Policy and the Acceptable Use Policy.
  5. While you should read this document in full, here are some especially important points:
    • we provide no warranties to you whatsoever and do not offer any guarantees
    • you agree to waive any claim against us for any interruption of service, loss of your data, security breach or any other reason
    • you are responsible for backing up your data
    • if you subscribe to our service, you agree to be the primary support contact for your members

Subscriptions

Subscribers have special obligations under these terms. If you subscribe to our service, this section applies to you.

  1. Subscriptions are automatically renewed on a month-by-month basis. You agree to pay the prescribed fees for your subscription.
  2. We will charge your credit card on a monthly in advance. This will recur on a calendar month basis until you stop the subscription.
  3. You agree that if you do not pay your subscription, your site members will no longer to able to send and receive messages via OnlineGroups.net.
  4. You agree that we are not obligated to store content that relates to the groups covered in your subscription after your subscription has lapsed.
  5. You agree that you are not eligible to have your subscription fees refunded for any reason.

Service Levels

  1. We agree to take all reasonable measures to provide a high level of service.
  2. OnlineGroups.net does interrupt service for short periods to perform routine maintenance and to upgrade the service. This typically occurs between midnight and 6AM ET. Planned outages usually result in less than one minute's interruption and do not affect email delivery.
  3. If a major interruption of service is expected, we agree to notify you via the "Administrator's Group". A major interruption of service is defined as an interruption that we believe may take longer than 10 minutes during 8AM-6PM ET.
  4. Unexpected interruptions do occur, albeit rarely. During an unplanned outage, OnlineGroups.net will provide its best efforts to repair the system as quickly as possible. We will communicate with you via the "Administrator's Group".
  5. In the event that our service is interrupted during a time that is important to you, you agree that you are not eligible for compensation due to anything that may occur as a result of that interruption.
  6. You agree that we may disable your account or restart our service if we decides that you or your site members are utilising a high level of our system resources, such as RAM, CPU or storage. We operate a hosted solution that is shared by others. If your service needs exceed the shared capacity, we will discuss options for hosting you on dedicated resources that may be more appropriate for your needs.
  7. You agree that you are responsible for maintaining backups of your own site. We provide you with an export functionality from within the service. This enables you to back up your site and its message history at any time.

Information Management

  1. You agree to license us with rights for your content to enable us to provide our service to you. This includes the right for us to make multiple copies of your content and to distribute that content to others.
  2. You agree to allow content hosted on our servers to be stored by us in any location that we deems reasonable for the purposes of operating our service. You also agree that we are not obligated to automatically delete content generated after after your subscription has ended.

Support

Subscribers have special obligations under these terms. If you subscribe to our service, this section applies to you.

  1. You agree to be the first point of support for the members of the groups that you administer. We are happy to provide support to you, so that you are able to fulfil this function.
  2. You agree to using the "Administrators Group" as the primary source of support for our service.
  3. We agree to assist you via support@onlinegroups.net.

Updates to These Terms

  1. We reserve the right to change these terms of service at any time, without notice.

Waiver of Rights

  1. You agree to waive any claim to compensation due to service interruption, even if the interruption could have been avoided. This waiver applies to both planned and unplanned interruptions.
  2. You agree that we are not liable for loss of information or due to hardware failure, software failure, misconfiguration, security breach for any other reason. This waiver applies to commercially sensitive information and all other forms of restricted information, such as information protected by security classifications.
  3. You agree that we are not liable for any defamatory content that is distributed by us in the course of operating our service.
  4. You agree that we are not liable for the breach of any intellectual property right, or related right, for content distributed in the course of operating our service.
  5. You agree that we are not liable for the mis-distribution of information due to hardware failure, software failure, misconfiguration, breach of security or any other reason.

No Warranty

  1. WE PROVIDE THIS SERVICE TO YOU WITH NO WARRANTY. YOU AGREE TO USE OUR SERVICE AT YOUR OWN RISK. WE DO NOT WARRANT THIS SERVICE TO BE FIT FOR ANY PARTICULAR PURPOSE.
  2. We do not guarantee that your experience will be error-free, uninterrupted or completely secure.
  3. Our service is provided to you on an "as is" basis. Our service is not fit for any particular purpose. If you believe that we have made one, we disclaim any implied warranty relating to our service.
  4. Technical services can often break at frustrating moments. The root cause can be difficult to diagnose. We do not agree to provide any guarantee that service interruptions will be quickly resolved. You agree that we will not be liable for any damages relating to service interruptions, mis-configured software or any other reason.
  5. All services provided over the Internet are at risk of security breaches. You agree that we will not be liable for any damages relating to security breaches by us, our previous staff or other parties.
